The vehicle is essential for inspection and evidence gathering. Without it, pursuing a defect case becomes significantly more challenging.
Serious injuries, such as those resulting from seat belt failures or airbag defects, may qualify for a case. It's important to consult with a lawyer to evaluate the specifics of your situation.
Automobile design and defect cases are tough cases. The very first thing you have to have is the automobile itself. If that car gets out of your control, then you don't have an automobile design and defect case. We are required to obtain an expert opinion right off the bat about what failed in the car. There are certain cars that we know have defects. But automobiles or trucks particularly had for years a seat belt that would disengage if the truck went upside down. I sued Azuzu and I required them to rebuild the B pillars because when those cars would roll over, the seat belts would let loose and spool and people could leave the vehicle and my client did. When you sue Azuzu or another foreign manufacturer, you have to go through the Hague Convention. These cases are intensive. They're expensive. You can't do it if somebody wasn't grievously injured. We see a lot of people that come in that think they have a design or a defect case from the failed airbag deployment, for instance. If a car flops, it goes off the road and flops, an airbag won't deploy. And they're not designed to. You have to have an impact to the front of the car and then that impact has to be within about 45 degrees on either angle. So in these cases, there are airbag defect cases that have metal in the airbags and if you're hurt by those, we'd like to look at it. If you have somebody who's really seriously injured, we can handle these cases and we do but we have to have the car. So don't let that car get away from you. Be sure it's in storage and we'll take the storage over when we get the case but we have to have the car to inspect.
