We're all familiar with the saying, "For the moment we're born, we're dying." That's never more apparent than in today's society with an ever increasing and aging population. We are seeing more and more of our loved ones and friends and family members entering into nursing homes for care, whether that's long-term care or acute care for rehabilitation purposes. The problem in most nursing facilities and other long-term care institutions is that they are underfunded, which leads to a lack of staffing. That is where injuries occur, such as bed sores or broken bones. Now, once your loved one enters into a nursing home facility, the other thing you're asked to do is sign a contract for care. Most people don't realize that within that contract, there is an arbitration agreement. An arbitration agreement says you're not entitled to a jury if you or a loved one are injured in a nursing home, but you have to go to arbitration and you and your lawyer will select a party to hear your case like a private judge. That is where our negotiation skills come into such play where it's necessary to be able to negotiate not only who the arbitrator may be, but the presentation of evidence to maximize you or your loved one's recovery.
