$95,000.00 – Verdict / $25,000.00 – Settlement
This automobile accident resulted from the plaintiff being t-boned at a red light by a driver who was driving under the influence of meth. Our client received injuries to his left hip, suffered a broken rib and injured his neck in the accident. The defendant driver’s insurance promptly paid their policy limits of $25,000.00.
At that time, we made a claim against my client’s uninsured/underinsured motorist coverage. The UM/UIM carrier offered to settle all claims for $2,332.02. Given the facts of the accident and the defendant driver’s erratic behavior at the scene of the accident, at that time we counteroffered to settle with the uninsured/underinsured motorist coverage carrier for the policy limits of $100,000.00. The carrier countered back with a final offer of $22,688.02.
The case proceeded to trial where the plaintiff received a verdict of $95,000.00.
