This accident occurred on January 9, 2008, when the Defendant, who was driving on a suspended driver’s license at the time of the accident, failed to yield the right of way to the Plaintiff therefore causing the accident that made the basis of this suit.  The Defendant was on the job at the time of this accident and the employer had no mechanism in place that allowed them to monitor the status of their employees’ driving records or the status of their driver’s license.  The Plaintiff has suffered serious injuries as a result of this accident.

Mediation was conducted and the Plaintiff was offered $250,000.00 but declined said offer.  The case proceeded to trial.  The Plaintiff, other witnesses, and expert witnesses took the stand and gave testimony.  After the Defendant’s expert witness testified, a break was taken and before trial resumed the Defendant offered $625,000.00 to settle this matter, which the Plaintiff accepted.
